Controller for Data Processing
Enzove, or Robin Holl Einzelunternehmen, under the VAT ID DE359819504
(hereinafter referred to as "Enzove" or the "Company"), is responsible for the processing of personal data collected and processed in
connection with this Privacy Policy through the Companys websites (hereinafter referred to as the "Websites") as well as through
Enzove devices, products, services, online stores, and applications (hereinafter collectively referred to as "Enzove Services").
All key information about the Company, including its address, is listed in the imprint.
Scope and purposes
This privacy policy (hereinafter referred to as the “Privacy Policy”) applies to all Enzove services and their users
(hereinafter referred to as the “Users”). It is intended to inform users about how Enzove processes personal data.
The privacy policy is subject to the German data protection law.
Personal Data
Personal data includes all information that can be used to directly or indirectly identify a user (hereinafter referred to as “personal data”).
Anonymized information means personal data that has been properly processed in such a way that the user can no longer be identified.
They do not fall within the definition of personal data.
Origin of personal data
The personal data processed by Enzove comes from three sources:
- Personal data provided by the user: The user transmits this data to Enzove on his own initiative, in particular when he registers for Enzove services, sends messages to Enzove (e.g. support request) or agrees to participate in a survey.
- Personal data resulting from the use of Enzove services: This is data that arises when using Enzove services or is collected on this occasion (e.g. identifiers and characteristics of the terminal devices used for access to the Enzove services, the generation of logs, etc.).
- Personal data from other sources: This data is transmitted to us by third parties with whom we do business, in particular through processors and partners (e.g. the delivery data of the end devices is transmitted to us by our logistics partner).
Personal Data Collected
Enzove does not collect personal data regarding users use of Enzove, except where processing is essential for the proper functioning and optimization of Enzove Services or where the user has explicitly provided consent.
Enzove may collect personal data when a user utilizes Enzove Services, particularly the following categories of data (each category includes a non-exhaustive list of examples to better illustrate the type of data collected):
1. Civil and Identification Data (e.g., name, first name, address, phone number, email, pseudonym): This data is provided by the user when registering for Enzove Services or accessing their account.
2. Lifestyle Data (e.g., country of residence, language, habits, preferences): This includes the users country of residence, spoken language, survey responses, or preferred times of day for using Enzove Services.
3. Economic and Financial Data (e.g., billing, banking information, payment status, subscription type): This includes data related to the billing and payment of Enzove Services, if applicable (e.g., amount owed, amount paid, payment deadlines), as well as the payment method used (e.g., type of payment, expiration date of the credit card).
4. Connection Data (e.g., access data, logs, IP address, device identifiers and characteristics, internet provider, connection quality): This includes details about the users connections to Enzove Services, identifiers and characteristics of the connected device (e.g., a Windows 10 PC with an integrated graphics card), and connection data (e.g., network provider, type of connection, Ethernet, transmission speed, packet loss, etc.).
5. Internet Data Related to Website Navigation (currently enzove.com / *.enzove.com / enzove.cloud / *.enzove.cloud) (e.g., navigation data, cookies, trackers, visitor metrics): This includes data such as visits to the community page on enzove.com and the use of social network features (e.g., YouTube, Twitter, etc.) on the website.
6. Communication Data (e.g., user satisfaction, messages to customer service, messages on social networks or forums, communications to the company): This includes customer service tickets, messages on social networks or forums, and responses to satisfaction surveys.
The personal data collected varies depending on the user and the specific Enzove Services they utilize (for instance, certain data pertains only to Enzove websites, while other data relates exclusively to the Enzove service). Additionally, some data is processed only with the users consent (see the "Legal Basis for Data Processing" section).
Enzove does not process or collect sensitive data.
Purposes of data processing
Enzove processes personal data to operate, provide, improve, and inform users about Enzove services. Depending on the services used, personal data may be processed for the purposes outlined below:
First, we process some of your data to ensure the smooth operation and delivery of Enzove services.
This includes managing contractual and business relationships (orders, subscriptions, billing, accounting, outstanding payments, etc.), ensuring the proper technical and administrative functioning of Enzove services, providing access to the services, assisting users with their use of Enzove services, responding to messages and questions from users, and sending notifications in case of technical issues.
For example, Enzove processes your personal data to manage your subscription, respond to user support requests, or notify users about maintenance or incidents.
Second, we process some of your personal data to improve and optimize Enzove services.
This includes measuring and enhancing the quality of Enzove services and user satisfaction, tracking user navigation, generating statistics on Enzove services and their usage, managing and optimizing server operations, tailoring services to user needs—particularly concerning server hardware—and creating user profiles to enable service improvements and optimizations.
For instance, Enzove processes your personal data to measure the impact of an update based on user satisfaction or usage rates, regulate server cooling, or determine whether a user tends to use Enzove in the morning or evening.
We also process some of your personal data for communication and marketing purposes.
This includes providing updates and news, managing user subscriptions to newsletters and communications, conducting surveys, organizing contests and promotional games via drawings or other methods, and communicating about new Enzove services, targeted or untargeted commercial or promotional offers, and partnerships with third parties.
For example, Enzove processes your personal data to send newsletters, offer surveys or contests, or introduce a new service or feature to users.
Finally, we process some of your personal data to achieve the following goals:
Ensuring that Enzove services are used in compliance with the general terms of use and applicable laws, guaranteeing the security and integrity of systems, fulfilling our legal obligations (including ensuring contractual and business relationships comply with regulations), and responding to administrative or legal requests in accordance with applicable legislation.
For instance, Enzove processes your personal data to confirm account ownership, prevent or address attacks on server integrity, or handle user requests regarding personal data.
Duration of data storage
Depending on the processing of the personal data, the storage period can be 1 to 10 years: The personal data processed as part of the fulfillment of a contract or due to a legal obligation will be stored for a maximum period of 10 years from the end of the contractual relationship. The personal data processed as part of a consent will be kept for up to 3 years after receiving the consent, unless the user requests deletion. The personal data processed within the framework of a legitimate interest will be retained for a maximum period of 5 years from the end of the contractual relationship. After the retention periods have expired, Enzove deletes or anonymizes the relevant personal data.
Cookies
The use of the websites also includes the use of cookies, web beacons or other mechanisms such as web beacons (hereinafter referred to as “cookies”).
User rights
The user has the right to request the restriction of the processing of their personal data in the following cases and according to the following modalities:
The user believes that the processing of their personal data is unlawful: They refuse the deletion of the personal data and instead request the restriction of its use (e.g., in cases of identity theft).
The user disputes the accuracy of their personal data: They request the restriction of processing for a period that allows the controller to verify the accuracy of the personal data.
The user wishes their personal data to be retained for the establishment, exercise, or defense of legal claims: The personal data is no longer necessary for the provision of Enzove services, but we retain it upon the users request.
In the event of restricted processing, personal data will only be processed—apart from storage—with the users consent, or for the protection of the rights of another natural or legal person, or for reasons of significant public interest.
If the restriction of processing is lifted, the user will be notified in an appropriate manner (e.g., via email or postal mail).
Right to Erasure of Personal Data
This right, also referred to as the "right to be forgotten," enables the user to request the deletion of their personal data. When exercising this right, the user requests that their personal data be deleted.
This right applies under applicable law to the following two types of personal data:
Personal data that is no longer necessary for the purposes for which it was collected or processed; and
Personal data processed based on the users consent (e.g., for receiving newsletters).
Right to Data Portability
The user may request to receive their personal data in a structured, commonly used, and machine-readable format.
Under applicable law:
This right applies when data is processed automatically based on the users consent or to fulfill a contract;
This right is limited to the personal data provided by the user; and
This right must not infringe upon the rights and freedoms of others.
Right Not to Be Subject to Automated Individual Decision-Making
The user may request not to be subject to a decision based solely on automated processing.
Exercising Rights
To exercise any of these rights, the user is invited to send an email to the following address: dpo@enzove.com.
The user will receive a response within one (1) month of the requests receipt. This period may exceptionally be extended by up to two (2) months if necessary, considering the complexity and number of requests. The user will be informed of the extension via email.
For confidentiality and data protection purposes, a signed copy of the users identification document must be included with the request.
In cases of manifestly unfounded or—particularly in cases of frequent repetition—excessive requests, the controller may refuse to act on the request or charge a reasonable fee that accounts for the administrative costs of processing the request.
If the response is unsatisfactory, you have the option to contact the CNIL.
